These are the General Terms and Conditions for contracting, accessing, and using Funecon.es.

Funecon is a registered trading name of MEMORARE 39, SOCIEDAD LIMITADA.

The following terms regulate the relationship between MEMORARE 39, SOCIEDAD LIMITADA (“Funecon”) and its users (as defined below) regarding the contracting, access, browsing, and general use of the platform: https://funecon.es (the “Platform”).

1. Purpose and Content of the Platform

The aim of this Platform is to make arranging funeral services (“Services”) easier and more transparent.

Services may be offered under two contractual regimes:

  1. Direct services provided by Funecon, where our trusted funeral partners deliver the service in the interest of the customer/user.

  2. Intermediated services, where Funecon acts as a commercial agent for other independent funeral providers. In these cases, Funecon operates as a marketplace and intermediary between Users and Service Providers (“Providers”), receiving a commission from the Provider for each booking. The customer pays Funecon, who collects payment on behalf of the Provider.

Funecon is not responsible for any errors or omissions in the information provided, except as required by applicable law, nor for the specific application or use of such information.

We reserve the right to update, modify, or delete content, general conditions, and legal policies at any time without notice, as well as to limit or block user access.

2. User Conditions

A “User” is any person who accesses, browses, uses, or contracts services via the Platform.

2.1 Browsing

Browsing and accessing the Platform does not require prior registration. However, when requesting a quote, a user account will be automatically generated, which you may delete at any time via the link provided by email.

2.2 Applicable Regulations

If you register as a consumer (individual), consumer protection laws apply. If you register as a business or self-employed professional, these Terms and Conditions apply without the additional consumer protections.

2.3 Accuracy of Data

Users must act lawfully, responsibly, and in good faith, guaranteeing the accuracy of all data provided. Providing false or inaccurate information may result in refusal of service.

2.4 Identity Verification

Funecon is not obliged to verify user identity. We reserve the right to reject any registration or booking request if it does not meet Platform requirements.

3. Platform Operation

3.1 Browsing

The Platform provides information about Funecon and its Services, including descriptions, images, and prices.

3.2 Service Selection

Users can select from available Services and compare offers based on location, price, availability, and additional options.

3.3 Booking

Once a selection is made, the Platform generates a non-binding offer. The user may view it online or receive it via email.

For direct services and intermediated services, the contract is between the fneral director and the user, with Funecon acting solely as an agent.

The contract will specify service details and pricing. By contracting a service, the user agrees to pay all applicable charges, taxes, and fees. The contract becomes effective upon confirmation email.

3.4 Additional Conditions

In addition to these Terms, the specific terms set out in the contract and the Provider’s own terms will apply.

3.5 Post-Contract Process

After booking, the Provider will contact the user directly to begin service delivery.

3.6 Payment

Payment is made directly to Funecon.

3.7 Third-Party Websites

Our Platform may contain links to third-party websites. Funecon is not responsible for any contractual relationship between the user and third parties.

4. Cancellation Policy

4.1 General Rule

Under Article 103(a) of Spanish Royal Legislative Decree 1/2007, once the contract is confirmed, it cannot be cancelled without the express consent of the user and Funecon. Due to the urgent nature of funeral services, the right of withdrawal does not apply once service delivery has started.

4.2 Fraudulent Orders

Funecon reserves the right to cancel any booking suspected of fraud.

5. Liability

5.1 User Responsibility

Users must use the Platform lawfully and provide accurate data.

5.2 Independence of Funecon

Funecon acts as an intermediary in certain cases and is not responsible for the quality or execution of services provided by independent Providers.

5.3 Funecon’s Responsibility

Funecon is responsible for the correct operation of the Platform and for communication before contracting.

5.4 Force Majeure

We are not liable for service interruptions caused by unforeseen events beyond our control.

5.5 Provider Responsibility

The Provider is responsible for service delivery and related claims.

5.6 Claims

Claims should be directed to the provider and Funecon to be informed in the case that a provider should be removed from our list of providers. 

6. Intellectual and Industrial Property

All Platform content is owned by Funecon or authorised third parties and is protected by intellectual property laws. Use, reproduction, or distribution without permission is prohibited.

7. Language

In case of discrepancy between the Spanish version of these Terms and any translation, the Spanish version prevails.

8. Applicable Law and Jurisdiction

These Terms are governed by Spanish law. Any disputes shall be submitted to the courts of Almería, unless mandatory consumer protection rules provide otherwise.
